Homeowner Zen – Standard Customer Agreement

This Standard Customer Agreement (the "Agreement") is made between **Homeowner Zen, LLC** (the "Company") and the undersigned customer (the "Client"). By approving any Company‑generated estimate, scheduling a service through the Company’s online booking platform, or otherwise accepting the Company’s services, the Client automatically agrees to all terms and conditions set forth below.

1. Scope of Services

The Company provides basic residential home services, which may include but are not limited to:

1. Replacement of HVAC air filters.

2. Replacement of lightbulbs.

3. Inspection of visible plumbing for leaks (e.g., under sinks).

4. Cleaning of dryer vents and related lint removal.

The Company’s employees and subcontractors (collectively, “Technicians”) will perform only the specific tasks listed on the applicable estimate or work order.

2. Acceptance of Terms

Acceptance of these terms is **automatic** when the Client (a) accepts any estimate issued by the Company, or (b) books a service through the Company’s online platform. No additional signature is required.

3. Entire Agreement / No Oral Modifications

This Agreement constitutes the **entire understanding** between the parties. **No oral statement, promise, or commitment** made by any Technician, employee, or subcontractor shall modify or supplement these terms unless agreed to in a written amendment signed by both parties.

4. Property Access

The Client grants the Company and its Technicians permission to access the property **with little or no notice** at the scheduled service time. Access details (e.g., lock‑box codes, smart‑lock access, gate codes, or other instructions) may be provided orally or through the Company’s online booking platform.

5. Water Use

Certain services require up to **two (2) gallons of water** (e.g., for flushing refrigerator filters or verifying drain flow). The Client authorizes such water use and agrees that the Company is **not liable** for damages arising from normal water usage during service.

6. Electricity Use

Services may require the use of a standard 120‑volt household outlet to power equipment such as vacuums. The Company is **not liable** for any damages arising from normal electricity usage during service.

7. Conflicting Services / Site Conditions

Services **cannot** be rendered while other construction, remodeling, or home‑improvement projects are in progress if they impede access or create safety conflicts. If conflicting work necessitates cancellation, the Client will receive a refund **minus a US $100 rescheduling fee**.

8. Severe Weather

If severe weather makes service unsafe or impractical, the appointment will be rescheduled for the **next available business day** at no additional charge.

9. Payment Terms

- **Standard Services:** Payment is due **at the time of service**, prior to work commencement.

- **Filter Replacements:** Payment is due **within three (3) calendar days** after service completion. If payment is not received within that period, any scheduled follow‑up service will be **canceled**.

10. Client Obligations

1. The Client must ensure **clear and unobstructed access** to HVAC equipment and other service areas.

2. If HVAC equipment cannot be accessed with minimal effort, the appointment will be canceled and any payment refunded **minus a US $100 rescheduling fee**.

3. For all other services, Technicians will complete tasks that can be **reasonably accessed**; any severely obstructed items may be skipped at the Technician’s discretion.

11. Cancellations & Rescheduling

- The Client may cancel or reschedule at any time **more than 72 hours** before the service window without penalty.

- Cancellations made **within 72 hours** of the service window, after payment processing, will be refunded **minus a US $100 rescheduling fee**.

12. Content Use Authorization

The Client grants the Company permission to capture and use **photographs and/or videos** taken during service for marketing, training, or documentation purposes. No personally identifying information will be disclosed without the Client’s prior written consent.

13. Liability & Claims

1. The Company is liable **only** for damages **directly caused by the proven negligence** of its employees or subcontractors.

2. The Company is **not liable** for: (a) inadvertent damage to electrical, HVAC, plumbing, or other systems during normal service procedures that is **not** caused by negligence; or (b) **pre‑existing** issues or damages to any system or component within the home.

3. Any claim for negligence must be **reported in writing within forty‑eight (48) hours** of service completion.

4. The Company shall have **fourteen (14) days** from receipt of a written claim to inspect, investigate, and respond before the Client pursues additional remedies.

14. Governing Law

This Agreement is governed by and construed in accordance with the **laws of the State of Alabama**, without regard to its conflict‑of‑law provisions.

15. Miscellaneous

1. **Severability:** If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.

2. **Waiver:** Failure by either party to enforce any provision shall not constitute a waiver of future enforcement of that or any other provision.

3. **Amendments:** This Agreement may be amended **only** in writing, signed by both parties.
